Question:
How do I go about terminating an employee?
Answer:
If an employer calls us seeking to terminate an employee, we begin by evaluating all all of the options, of which there are several.
For example, if the employer is interested in offering an employee a severance package, we evaluate what the potential terms of that severance might be. We look at the risk of litigation and whether the employee truly has a claim.
Here in the state of Washington, we are an at-will employment state, which means that absent some illegality, an employee can be terminated, with or without cause. That said, each employment situation must be evaluated and treated differently, and there are several questions that must be answered.
- Is there an employment contract?
- Was there a handbook involved that may have given certain promises in certain situations?
- Do we need to evaluate whether state or federal leave laws are involved?
- Have we followed all the steps to assure that the employee has been given all necessary due process?
No one employment situation is going to be the same as another. It’s vital that as an employer, you contact an employment attorney early for help evaluating the best ways to keep your company out of litigation.
