      Question:

How do I determine the value of a slip and fall claim?

      Answer:

It’s natural for clients injured in slip and fall accidents to ask how much that claim is worth. Accurately determining that value, however, will almost always take some time.

To know the value of a claim, your Spokane slip and fall lawyer must conduct a thorough investigation. This will identify all the people who must be held accountable for compensating you for your damages. It will also enable them to gather evidence that will support your claim by connecting the careless actions of the people at-fault to your injuries.

In addition to the accident investigation, it’s necessary for the injured person to reach what is called “maximum medical improvement.” This means recovering to the fullest possible capacity. As such, time must pass before the doctors and then your attorney will know how the victim’s injuries are going to resolve.

Until you know how the injury’s going to turn out, it’s premature to settle a case or even discuss a settlement or a dollar value, because you might be underselling your claim.

As the weeks and months go by, your injuries may fully resolve. Or it may be that they are not going to resolve and instead become a permanent aspect of your life. These divergent outcomes take your claim’s value in different directions.

If you learn that your injuries have resolved, the conversation turns to, “Okay, the injuries have resolved. We know that you’ve missed this much work and your lost wages are X. Now we can put a value on this case.”

If on the other hand, if your injuries are not going to resolve, the conversation becomes, “Hey, we know your injuries are not going to resolve. This is going to be a permanent, lifelong thing. Now we need to take into consideration your lifelong lost wages. We need to get medical experts involved to talk about your ongoing treatment that you’re going to need. Then we can use that information to place a value on the claim.”

Determining a claim’s value is often complicated and can take time. An experienced slip and fall lawyer will guide you through the process to ensure you pursue all the compensation you are owed.
